TAKE NOTICE that the Council of the Corporation of the Town of Northeastern Manitoulin and the Islands will hold a public meeting on September 19, 2023, at 7:00p.m. located at 14 Water Street, Little Current, Ontario.

 

The purpose of this public meeting is to consider a proposed Zoning amendment to By-law No. 2018-41, as amended for the Town of Northeastern Manitoulin and the Islands pursuant to the provisions of Section 34 of the Planning Act, R.S.O. 1990, Chapter C. P. 13. to amend the zoning to allow for a 10.3 KW ground mount solar system.

 

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed By-law Amendment.

 

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Northeastern Manitoulin & the Islands before the proposed By-law Amendment is passed, the person or public body is not entitled to appeal the decision of the Council of the Town of Northeastern Manitoulin & the Islands to the Local Planning Appeal Tribunal.  

 

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Northeastern Manitoulin & the Islands before the proposed By-law Amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

TAKE NOTICE that the Council of the Corporation of the Town of Northeastern Manitoulin and the Islands will hold a public meeting on September 19, 2023, at 7:00PM at the Municipal Office, 14 Water Street East, Little Current. The purpose of this public meeting is to consider a proposed Zoning By-law Amendment under Section 34 of the Planning Act for the property located on Part of Lot 19, Concession 13; PIN 471350123, 471350691, & 471350690, 12040 hwy 6, Town of Northeastern Manitoulin and the Islands. The attached key map shows the affected property.

 

The effect of the proposed Zoning By-law Amendment is to rezone the affected property from the Shoreline Residential (SR) and Rural (RU) Zones to the Tourist Commercial, Special Exception X (C3-X) Zone in order to permit a tourist cabin establishment with the following exceptions:

  • Residential development is prohibited on the escarpment face itself including the approximately 25 metre high, 38 to 40 degree slope, a 10 metre setback at the crest, and a 15 metre setback away from the toe of the slope; and
  • The 10 metre setback from the crest of the slope to the shoreline below, also referred to as the break in slope from the upper horizontal surface, must be left as undisturbed as practically possible to allow for natural vegetation with the allowance for access to the water.

 

Specific provisions for building locations and other matters related to vegetation and water quality will be included in a site plan approval by the Town.

 

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed By-law Amendment.

At the Meeting of May 16, 2023, the Planning Authority of the Council of the Corporation of the Town of Northeastern Manitoulin and the Islands passed the following Resolution No. 111-05-2023 which includes:

RESOLVED THAT the Planning Authority of the Council of the Corporation of the Town of Northeastern Manitoulin and the Islands conditionally approves the application for consent as applied for by Mark and Linda Schreader,  File Number 2023-03, subject to the following conditions;

1.      Transfer of land form prepared by a solicitor and a schedule to the transfer of land form on which is set out the entire legal description of the parcel, 

2.      The applicant must deposit a Reference Plan of Survey in the Land Registry Office clearly delineating the parcels of land approved by The Town of Northeastern Manitoulin and the Islands in this decision and provide the Town Office with a copy.

3.      Prior to final approval by the Town of Northeastern Manitoulin and the Islands, the owner provide confirmation of payment of all outstanding taxes.
